1st time we've posted on the exact same thing. Linked ya.

Why is this even a first amendment issue? Is it because public school teachers are quasi-governmental employees? The first only guarantees that "Congress shall make no law"...so I don't see where Congress is coming into it.

*I* can certainly be fired for perfectly legal things I do in my own time, if they become public and embarrass my company. I'm not getting the Constitutional angle here.
